Terms and Conditions
Unless the parties agree otherwise in writing, the carrier shall not be liable for any special, consequential or other damages caused by more delay in the delivery of a shipment, regardless of the cause of such delay.
Limits Of Liability
Carrier shall not be liable for any loss, damage or unreasonable delays arising from the following causes:
- Acts of God, the Queen’s or public enemies.
- Authority of law
- Defect or inherent vice in the goods shipped
- Act of default of the shipper or owner of the goods
- Contamination by radiation, pollution, etc.
Declared Value Of Shipments
Carrier’s liability for loss, damage or injury to a shipment shall not exceed $1.00 per pound ($50.00 maximum) unless a higher value is declared on the face of the bill of lading and an additional transaction charge of $0.50 per $100.00 (or fraction thereof) is paid to the carrier. The carrier shall not be required to accept any shipment with a declared value in excess of $250.00 unless agreed to prior in writing by the carrier. The carrier must be informed of all declared values prior to the handling of the shipment.
Notice Of Loss Or Damage
Notice of loss of damage must be given to the carrier at its head office within twenty-four (24) hours after receipt of the shipment.
A $5,000 limit is applied in the research of reconstituting the files, excluding: money, tickets, valueables, stamp counts, claim titles, letter of credit, passports, railway tickets or other papers of value, original descriptive drawings or quotations, account books (except for their value in white).
